Terms of Service

• These Terms of Service (“Terms”) govern your use of the Mesa Yoga website, online services, studio services and online store (together, the “Services”).

• By accessing or using any of the Services, you confirm that you have read, understood and agree to be bound by these Terms and all referenced documents (including the Package & Membership Policy, Studio Policy, Shipping & Returns Policy and Privacy Policy).

• You agree to use the website and Services only for lawful purposes and in a respectful manner.

• You must not interfere with or attempt to interfere with the proper functioning of the website, circumvent security measures, or misuse any content or functionalities.

• Mesa Yoga may, at its sole discretion, restrict or terminate access to the Services if you violate these Terms or applicable law.

• If you create an account, you are responsible for maintaining the confidentiality of your login data and for all activities that occur under your account.

• You agree to notify Mesa Yoga immediately of any unauthorized use of your account or other security breach.

• Mesa Yoga may suspend or close accounts that are inactive for a prolonged period or used in breach of these Terms.

• All orders (classes, memberships, merchandise, events) are subject to availability and confirmation of payment.

• Prices are displayed in  CHF / main currency  and, where applicable, include VAT. Any additional fees (e.g. shipping) are shown separately at checkout.

• Mesa Yoga reserves the right to change prices, products and offerings at any time. Changes do not affect confirmed orders already concluded.

• The Package & Membership Policy and Shipping & Returns Policy form an integral part of these Terms for all relevant purchases.

• Mesa Yoga may issue promotional codes to selected eligible individuals or groups at its discretion.

• Promotional codes are personal and non‑transferable, valid only for specified products or services, for a limited period, and subject to any additional conditions communicated with the code.

• Codes cannot be combined with other offers, applied retroactively to past purchases or exchanged for cash.

• Mesa Yoga reserves the right to verify eligibility, request supporting documentation, cancel orders placed with misused codes, charge the price difference, suspend or terminate accounts, and refuse future service in cases of fraudulent or abusive use.

All content on the website (text, images, logos, videos, class materials, designs) is protected by intellectual‑property rights and may not be copied, reproduced, distributed or otherwise used without Mesa Yoga’s prior written consent, except for personal, non‑commercial use as permitted by law.

• Participation in classes, workshops, events and retreats offered by Mesa Yoga is at your own risk. You are responsible for ensuring you are physically and mentally able to participate.

• Before your first participation, you must read and accept the Liability Waiver; this waiver forms an integral part of these Terms.

• To the fullest extent permitted by Swiss law, Mesa Yoga and its instructors are liable only for damages caused by unlawful intent or gross negligence. Any further liability, in particular for indirect or consequential damages, is excluded to the extent permitted by mandatory law.

• Nothing in these Terms limits liability for death or personal injury caused by unlawful intent or gross negligence, or any liability that cannot be excluded under mandatory law.

• The collection and processing of personal data in connection with the Services is governed by our Privacy Policy, which forms an integral part of these Terms.

• By using the Services, you acknowledge that you have read our Privacy Policy and agree to the processing of your personal data as described therein.

• These Terms and all disputes arising out of or in connection with the Services are governed by substantive Swiss law, excluding its conflict‑of‑law rules.

• For consumers resident in Switzerland, the place of jurisdiction is determined by mandatory Swiss law. Otherwise, the exclusive place of jurisdiction is Regional Court of Maloja.

• Mandatory consumer‑protection rules in the customer’s country of residence remain unaffected where they apply and cannot be derogated from by agreement.
